Abstract
An illegal thalak whose implementation is thalak said outside court. Most 'people in the Tabir sub-district choose illegal thalak, and others choose thalak in court. The cause of the occurrence of an illegal thalak due to several factors: early marriage, economic, beta'lik, jealous, and social culture. at first practice of illegal thalak practice has become a culture of law as based on fiqh, but now transformed into the affairs of the court. It was intended to review the peace and good order the legal protection of women, children, family, country or religion.
